When a legal dispute places your business, property, finances or reputation at risk, choosing the right legal representation becomes an important decision.
At JY Ko Advocates & Solicitors, we approach litigation with careful preparation, legal analysis and a clear understanding of our clients’ objectives.
Based in Bangsar, Kuala Lumpur, our firm represents companies, business owners, directors, property owners and individuals in civil and commercial disputes, including contractual claims, corporate disputes, urgent injunctions and appellate proceedings.
1. Experience in Trial and Appellate Litigation
Our firm handles contested civil and commercial proceedings involving contractual obligations, financial claims, property rights and other legal disputes.
Our Managing Partner, Ko Jie Yang, has experience in proceedings before the Magistrates’ Court, Sessions Court, High Court, Court of Appeal and Federal Court of Malaysia.
Our litigation work includes trials, interlocutory applications, appeals, settlement negotiations and judgment enforcement.
We have also received instructions from other legal practitioners and firms in connection with contentious legal matters.
2. Strategic Litigation with Commercial Objectives in Mind
A legal dispute is not simply about determining who is right or wrong. It often concerns substantial financial exposure, business continuity, contractual obligations and future commercial relationships.
Before recommending a course of action, we consider the available evidence, applicable legal principles, potential remedies, litigation risks, costs and practical enforceability of any eventual judgment.
Depending on the circumstances, the appropriate course may involve negotiation, settlement, urgent court intervention or contested litigation.
Our objective is to develop a legal strategy that responds to both the legal issues and the client’s underlying commercial interests.
3. Managing Partner Involvement and Legal Oversight
JY Ko Advocates & Solicitors is led by Ko Jie Yang, whose principal practice involves civil and commercial litigation, contractual disputes and property-related proceedings.
Our firm adopts a collaborative approach to the handling of matters, with Managing Partner oversight of litigation strategy and important legal decisions.
We believe clients should receive clear explanations of their legal position, available options and the potential consequences of each course of action.
4. Experience in Urgent and Complex Disputes
Some disputes require prompt legal intervention to prevent further commercial loss or interference with legal rights.
Our experience includes urgent injunction applications, property caveat disputes, preservation of contractual rights, recovery of possession and other interlocutory relief.
We assess the urgency of each matter, the available evidence and the legal requirements for the relief sought before advising on the appropriate action.
5. Selected Successful Cases & Litigation Outcomes
At JY Ko Advocates & Solicitors, our litigation experience is reflected in the matters we have handled and the outcomes obtained for our clients.
Our firm has represented companies, business owners, property owners and individuals in contested civil and commercial proceedings, including appeals, contractual disputes, injunctions and property-related litigation.
The following are selected examples of our litigation work before the Malaysian courts.
1. Court of Appeal – Successful Appeal in Commercial Partnership Debt Dispute
Our firm represented the Appellant in a dispute concerning the liability of former partners for outstanding business debts.
The Court of Appeal allowed our client’s appeal, overturned the earlier High Court decision and reinstated our client’s claim arising from goods sold and delivered.
The decision concerned important legal principles relating to partnership liabilities and the enforceability of obligations against former partners.
2. Court of Appeal – RM1 Million Contractual Award Set Aside
Our firm represented the Appellant in a complex matrimonial and contractual dispute involving a financial obligation of approximately RM1 million.
The Court of Appeal allowed the appeal in part and set aside the High Court’s award enforcing an alleged contractual obligation arising from a withdrawn joint divorce petition.
The outcome removed a substantial financial liability previously imposed on our client.
3. High Court – Successful Removal of Private Caveat and Injunction
We represented a property owner whose commercial property had been subjected to a private caveat arising from a disputed claim for professional fees.
The Kuala Lumpur High Court ordered the removal of the caveat, granted an injunction restraining further caveats over the property and awarded general damages against the individual property negotiator, subject to assessment.
The orders protected our client’s proprietary rights against further interference.
4. High Court – Successful Stay of Commercial Litigation Pending Arbitration
Our firm represented the Defendants in a commercial dispute arising from a Share Sale Agreement containing an arbitration clause.
The Shah Alam High Court allowed our application under Section 10 of the Arbitration Act 2005 and ordered that the court proceedings be stayed pending arbitration.
The decision preserved our client’s contractual right to have the dispute resolved through the agreed arbitration process.
5. High Court – Urgent Injunction Protecting Business Operations
Our firm acted for a commercial tenant operating a restaurant business which faced an imminent interruption of its electricity supply.
Following an urgent application, the High Court granted an ad interim injunction preserving the existing position pending the subsequent hearing.
The order enabled our client to continue operating its business while the temporary injunction remained in force.
6. Sessions Court – RM216,000 Judgment and Vacant Possession
We represented a landlord in a tenancy dispute involving the tenant’s failure to comply with contractual payment obligations.
The Petaling Jaya Sessions Court entered judgment for RM216,000 in favour of our client and ordered the tenant to deliver vacant possession of the premises.
The judgment addressed both our client’s monetary claim and its right to recover possession of the property.
Litigation Experience Supported by Actual Court Proceedings
These selected matters demonstrate our firm’s experience in conducting appeals, defending contractual rights, obtaining interim relief, resolving commercial disputes and pursuing monetary and proprietary remedies.
We recognise that every legal dispute presents different risks, legal issues and commercial considerations. Our approach is to assess each matter individually and formulate an appropriate strategy based on the available evidence, applicable law and our client’s objectives.
