Ko Jie Yang – Managing Partner

Ko Jie Yang is an advocate and solicitor of the High Court of Malaya and the Managing Partner of JY Ko Advocates & Solicitors.
His principal areas of practice involve civil and commercial litigation, contractual disputes, property litigation, corporate disputes, urgent injunctions, debt recovery and appellate proceedings.
Litigation and Court Experience
Mr. Ko has experience in proceedings before the Magistrates’ Court, Sessions Court, High Court, Court of Appeal and Federal Court of Malaysia.
His litigation practice encompasses trials, interim and interlocutory applications, appeals, settlement negotiations and proceedings involving the enforcement of legal rights and judgments.
He has acted for companies, business owners, directors, shareholders, property owners and individuals in disputes concerning contractual obligations, financial claims, business relationships, land and property interests.
He has also received instructions from other legal practitioners and law firms in connection with civil litigation and appellate proceedings.

Mr. Ko’s practice involves disputes where the legal issues may have significant financial or commercial consequences for the parties.

A substantial part of Mr. Ko’s practice concerns disputes arising from business transactions, contractual relationships and property ownership.
These include contractual payment disputes, debt recovery, directors’ and shareholders’ disputes, tenancy and possession matters, private caveats, strata management and urgent applications for injunctive relief.

Selected Successful Cases and Litigation Outcomes
Over the years, Ko Jie Yang and the legal team at JY Ko Advocates & Solicitors have represented clients in a range of contested civil and commercial proceedings before the Malaysian courts, including the High Court and Court of Appeal.
Our experience includes contractual disputes, appellate proceedings, property litigation, urgent injunctions, arbitration-related applications and negotiated settlements involving substantial financial interests.
The following are selected examples of matters handled by our firm.
1. Court of Appeal – Successful Appeal in Partnership Debt Dispute
Our firm represented the Appellant in a commercial dispute concerning the liability of former partners for outstanding partnership debts.
The Court of Appeal allowed our client’s appeal, overturned the earlier High Court decision and reinstated our client’s claim arising from goods sold and delivered.
The appeal involved the interpretation of the Partnership Act 1961 and the legal effect of an earlier judgment obtained in proceedings to which our client was not a party.
2. Court of Appeal – RM1 Million Contractual Award Set Aside
Our firm represented the Appellant in a matrimonial and contractual dispute involving an alleged financial obligation of approximately RM1 million.
The Court of Appeal allowed our client’s appeal on the relevant contractual issue and set aside the High Court’s award enforcing the alleged obligation arising from a withdrawn joint divorce petition.
This outcome removed a substantial financial liability previously imposed upon our client.
3. High Court – Successful Removal of Private Caveat and Injunction
Our firm represented a property owner in a dispute arising from private caveats lodged over commercial property in connection with an alleged professional fee claim.
The Kuala Lumpur High Court ordered the removal of the private caveat and granted an injunction restraining the lodging of further caveats over the property.
The Court also awarded general damages against the individual property negotiator, subject to assessment.
The orders provided protection against further interference with our client’s proprietary rights.
4. High Court – Successful Stay of Commercial Proceedings Pending Arbitration
Our firm represented the Defendants in a commercial dispute arising from a Share Sale Agreement containing an arbitration clause.
The Shah Alam High Court allowed our application under Section 10 of the Arbitration Act 2005 and ordered the court proceedings to be stayed pending arbitration, with costs awarded in favour of our client.
The decision preserved our client’s right to rely on the agreed contractual dispute resolution mechanism.
5. High Court – Urgent Injunction Protecting Business Operations
Our firm acted for a commercial tenant operating a restaurant business which faced an imminent interruption of its electricity supply.
Following an urgent application, the High Court granted an ad interim injunction preserving the existing position pending the hearing of the injunction application.
The temporary relief enabled our client to continue its business operations while the order remained in force.
6. Sessions Court – RM216,000 Judgment in Tenancy Dispute
Our firm represented a landlord in proceedings arising from the tenant’s failure to fulfil contractual obligations under a tenancy agreement.
The Petaling Jaya Sessions Court entered judgment for RM216,000, representing the tenancy sum claimed, and ordered the tenant to deliver vacant possession of the premises.
The judgment addressed both our client’s monetary claim and its right to recover possession of the property.
7. Successful Negotiated Termination of RM1.39 Million Property Agreement
Our firm represented a purchaser seeking an early termination of a Sale and Purchase Agreement involving a property valued at approximately RM1.39 million.
Despite our client having already paid more than 50% of the purchase price, we successfully negotiated an agreed termination with the forfeiture limited to 10% of the purchase price.
The outcome demonstrates the importance of considering commercially practical settlement options alongside the risks and costs of contested litigation.
