JY Ko – Successful Application of Urgent Injunction (Ad Interim / Interim Injunction)


We are pleased to announce that we have managed to obtain an Ad Interim Order granted by the Learned High Court Judge.

Brief Facts/Chronology:

  1. Our Client is a tenant of a unit in a stratified property. They are operating a restaurant business.
  2. The electricity provider company (or “Licensee”) together with the JMB suspected that the meter in the unit has been tempered with.
  3. One day without any notice, the Licensee company and the JMB had barged into our Client’s unit and forcefully conducted inspections at the meter.
  4. Two weeks after that, our Client had a notice pasted outside of the unit stating that the electricity supply will be cut off on the day after tomorrow.
  5. One (1) day before the electricity supply was cut off, our Client and us had a meeting from 5.15 PM until 8.00 PM and we had immediately begun to draft the Court papers until 5.00 AM in the morning. We then filed the Court papers in the morning itself and managed to schedule for an immediate and urgent Hearing of our injunction application at 3.00 PM at the same day.
  6. The Injunction application was made pursuant to Order 29 of the Rules of Court 2012 and Section 51 in the Specific Relief Act 1950 and other relevant provisions.

Order For Ad Interim Injunction:

The High Court, satisfied with our urgency and our need to apply for an interim injunction to preserve the status quo (i.e. to remain everything as it is pending final resolution) had granted us the temporary Ad Interim Injunction pending full Hearing of the Injunction, where the Ad Interim Injunction itself will subsists until the Hearing date on 11 September 2025.

    Consequence of Injunction

    With the Injunction Order, our Client may continue to operate their business while the Ad Interim Injunction is in force.
