Another Successful Debt Recovery Case: JY Ko Secures Court Order Directing Bank to Pay RM45,696.94

Winning a Court Case Is One Thing. Getting Your Money Back Is Another.

At JY Ko Advocates & Solicitors, we are pleased to share another successful outcome for our corporate client in a debt recovery matter before the Magistrates’ Court of Shah Alam, Selangor.

On 23 September 2026, we successfully obtained a Final Garnishee Order directing a bank to pay RM45,696.94 towards the outstanding judgment debt owed to our client.

This was an important milestone because many creditors face a frustrating reality: even after winning their cases in Court, their debtors may still refuse or fail to make payment.

For business owners, an unpaid debt is not merely a number on an invoice. It represents money that could otherwise be used to pay employees, suppliers, operational expenses or support business growth.

Our role as litigation lawyers does not necessarily end when judgment is obtained. Where appropriate, we also pursue enforcement proceedings to help our clients recover what they are legally entitled to receive.

How the Case Started

Our client had successfully obtained a Judgment in Default of Appearance against another company on 8 June 2026.

Under the judgment, the debtor company was required to pay:

  • RM43,046.00 in principal judgment debt;
  • Interest at 5% per annum; and
  • RM2,191.00 in legal costs awarded by the Court.

However, despite the Court judgment, the amount remained unpaid.

As at 27 July 2026, the outstanding amount, including the calculated interest and costs, stood at RM45,696.94.

At this stage, simply possessing a favourable Court judgment was insufficient to secure payment.

We therefore proceeded with further legal action to enforce the judgment.

Our Strategy: Pursuing the Debtor’s Bank Accounts

One of the important aspects of this case was identifying a possible source of funds belonging to the judgment debtor.

From the available financial records, we identified previous banking transactions involving RHB Bank and RHB Islamic Bank.

These records provided a factual basis for our application to pursue garnishee proceedings against the relevant financial institutions.

Instead of merely sending further demands to the debtor, we took steps to obtain a Court order against funds that might be payable by the banks to the debtor.

On 30 July 2026, we filed an application supported by affidavit evidence for a Garnishee Order.

The Court subsequently issued an order to show cause on 21 August 2026.

Following the necessary Court proceedings, the matter was heard on 23 September 2026.

The Successful Outcome: A Final Garnishee Order for RM45,696.94

On 23 September 2026, the Magistrates’ Court of Shah Alam granted the Final Garnishee Order against RHB Islamic Bank Berhad.

Importantly, the Court ordered the bank to immediately pay our client RM45,696.94 towards satisfaction of the outstanding judgment debt and costs.

The amount comprised:

DescriptionAmount
Principal judgment debtRM43,046.00
Interest calculated up to 27 July 2026RM459.94
Court-awarded legal costsRM2,191.00
TotalRM45,696.94

The proceedings against the other bank, RHB Bank Berhad, were discontinued under the same order.

This was a significant achievement for our client because the enforcement process had progressed beyond obtaining a judgment against the debtor.

We had successfully obtained a Court order requiring a third-party bank to pay the judgment debt directly to our client.

The order represents an important step towards actual recovery of the outstanding sum.

What Is a Garnishee Order? A Simple Explanation

Many business owners may not be familiar with the term “Garnishee Order”.

In simple terms, a Garnishee Order allows a person who has won a Court judgment to seek payment from a third party that owes money to the judgment debtor.

For example:

Suppose Company A owes Company B RM50,000.

Company B sues Company A and successfully obtains a Court judgment. However, Company A still refuses to pay.

If Company A has money in a bank account, Company B may apply to the Court for a Garnishee Order against the relevant bank.

Where the legal requirements are satisfied, the Court may order the bank to pay money that it owes to Company A directly to Company B, up to the amount recoverable under the order.

In other words, the creditor may be able to recover the judgment debt without relying on the debtor to voluntarily make payment.

However, garnishee proceedings are subject to legal requirements, including whether the third party actually owes an attachable debt to the judgment debtor.

This makes garnishee proceedings a potentially powerful tool in commercial debt recovery cases in Malaysia.

Why This Case Matters to Business Owners

One lesson from this case is that obtaining a judgment does not automatically mean that the debtor will pay.

Many businesses are discouraged when they have spent time and legal fees pursuing a debtor, only to discover that payment remains outstanding even after judgment.

However, a creditor who has obtained judgment may still have various enforcement options available under Malaysian law.

Depending on the debtor’s circumstances, these may include garnishee proceedings, seizure and sale proceedings and other appropriate enforcement mechanisms.

The choice of enforcement method is important.

In our case, the available banking transaction records helped us identify a possible avenue for enforcement. We pursued that avenue through the necessary Court procedures and ultimately obtained the Final Garnishee Order.

This demonstrates why debt recovery requires more than simply filing a lawsuit. It also requires careful consideration of how a favourable judgment can actually be enforced.

Our Commitment: From Court Judgment to Debt Recovery

At JY Ko Advocates & Solicitors, we understand that clients generally do not commence legal proceedings merely to obtain a piece of paper declaring that they have won.

For most business owners, the ultimate objective is straightforward: to recover the money owed to them.

That is why we approach debt recovery matters with attention to both the legal claim and the practical options for enforcement.

Our recent success before the Shah Alam Magistrates’ Court demonstrates our commitment to pursuing effective legal remedies for our clients.

By obtaining the Final Garnishee Order directing payment of RM45,696.94, we achieved an important enforcement outcome for our client.

Every debt recovery case is different, and the availability and effectiveness of enforcement proceedings depend on the evidence, the debtor’s assets and the applicable legal requirements.

Nevertheless, this case illustrates that a debtor’s failure to voluntarily honour a Court judgment does not necessarily mean that the creditor has reached the end of the road.
