Ko Jie Yang (Nick) – Managing Partner

Ko Jie Yang is a Malaysian advocate and solicitor and the Managing Partner of JY Ko Advocates & Solicitors. He practises primarily in civil and commercial litigation, dispute resolution, contractual disputes, property and land disputes, tenancy disputes, strata disputes, debt recovery and other contentious legal matters in Malaysia.

Mr. Ko has represented individuals, businesses, property owners, landlords, tenants, companies and other organisations in a broad range of civil and commercial disputes. He has also been engaged by established corporations and other law firms on a retainer basis, providing ongoing legal advice, dispute-resolution strategy, contractual analysis and litigation support.

Civil and Commercial Litigation in Malaysia

Mr. Ko’s practice is centred on civil and commercial litigation and the resolution of disputes arising from contractual, business and property relationships.

His experience includes proceedings before the Magistrates’ Court, Sessions Court, High Court, Court of Appeal and Federal Court of Malaysia, as well as the Industrial Court and other dispute-resolution forums.

He has acted in disputes involving contractual rights and obligations, unpaid debts, commissions, profit-sharing arrangements, business agreements, property transactions, tenancy and possession, land rights, strata management, construction and other commercial relationships.

His litigation experience also includes substantial-value commercial claims, debt recovery and enforcement proceedings, winding-up and insolvency matters, urgent injunction applications, arbitration-related proceedings and appeals involving questions of law.

Property, Tenancy and Strata Disputes

A significant part of Mr. Ko’s practice involves property-related disputes.

He acts in disputes involving landlords and tenants, tenancy agreements, possession, rental arrears, property rights, land-related claims, condominium and strata management, management corporations, renovation disputes and other issues concerning residential and commercial properties.

His experience in property litigation enables him to advise clients not only on the legal rights arising from an agreement or property interest, but also on the practical steps required to protect those rights through negotiation, court proceedings, injunctions or enforcement.

Commercial and Contractual Disputes

Mr. Ko regularly advises and represents clients in contractual and business disputes.

These matters may involve disagreements concerning the interpretation or performance of contracts, payment obligations, commissions, profit-sharing arrangements, service agreements, business relationships, breaches of contract and claims for damages.

Where appropriate, he assists clients in resolving disputes before litigation becomes necessary. Where court proceedings are required, he develops litigation strategies based on the contractual documents, available evidence, applicable law and the client’s commercial objectives.

Debt Recovery, Insolvency and Enforcement

Mr. Ko also handles debt recovery and enforcement matters, including substantial-value commercial claims and winding-up proceedings.

His experience includes proceedings involving significant debts and commercial obligations, as well as applications and proceedings relating to the enforcement of legal rights and judgments.

Debt recovery often requires more than obtaining a judgment. The appropriate strategy may involve identifying the correct debtor, assessing available security or assets, selecting the appropriate mode of enforcement and determining whether insolvency proceedings or other remedies are appropriate.

Appeals and Higher Court Litigation

Mr. Ko has experience handling appeals and proceedings before the High Court, Court of Appeal and Federal Court.

His appellate work involves reviewing the legal and evidential basis of a decision, identifying errors of law or fact where applicable, formulating appropriate grounds of appeal and presenting legal arguments in accordance with appellate procedure.

His experience across different levels of the Malaysian court system allows him to approach litigation with consideration not only of the immediate proceedings, but also of the potential appellate and enforcement implications of a decision.

Corporate and Retainer Work

In addition to acting on individual disputes, Mr. Ko has been retained by established corporations and other legal firms to provide ongoing legal services and support.

These retainer engagements may involve reviewing contracts and legal documents, advising on potential disputes, assessing legal and litigation risks, providing strategic input and assisting with contentious matters as they arise.
