Successful Application for Custody, Wife and Children Maintenance
We are proud to announce our latest outcome of one of our cases where we have on 30th April 2025 successfully obtained the sole custody of the children as well as wife maintenance and children maintenance for our Client pending the final divorce proceedings in Seremban High Court.
We are acting for the Wife and despite strong objection from the other side after exchanges of documents, we have managed to obtained the Judgment in our favour.
The summary of the Judgment are listed below (sensitive information have been removed):-
- The Plaintiff [our Client] is granted the sole custody, care and control of [4 children] (“the said Children”);
- The Defendant is granted overnight access to the said Children during alternate weekends from 12 noon on Saturday until 6 in the evening on Sunday;
- The Defendant shall pay children maintenance of RM3,000.00 monthly at the end of each month and to be paid to the Plaintiff;
- The Defendant shall pay wife maintenance to the Plaintiff for the sum of RM 700.00 monthly at the end of each month to be paid to the Plaintiff.
With regard to the amount of maintenance, despite that we claimed that the Defendant Husband has a very high income, supported by the amount of assets and the value of the business, the Learned High Court Judge was of the opinion that the Defendant Husband’s current payslips indicated that he may not be able to support his own basic lifestyle if a higher amount of maintenance is granted although he might be earning much more in the past.
